Terms relating to the provision of our terms
Thank you for booking with Bournemouth Beach Holidays. This website is owned and operated by Bournemouth Beach Holidays. This is the user agreement that governs your use of this website and the provision of the services we provide you. A binding contract between us comes into place when you have paid your deposit and we send you written confirmation. If you proceed to confirm your booking it will be deemed that you have read the terms and conditions and that you accept them.
Bournemouth Beach Holidays Ltd acts as an agent
When we arrange for accommodation to be reserved on your behalf, Bournemouth Beach Holidays will always operate in accordance with an agency model. As an agent, we act with our suppliers, such as the owner of the hotel or other accommodation type. We also act as your agent and we are responsible to you for the proper performance of those agency services. These terms form the contractual basis of that agency service. However, what that also means is that the final contract for your stay within the accommodation will be between you and the supplier.
As an agent we have no contractual liability to you in respect of the accommodation. If there is a problem with the accommodation then typically your contractual remedy will be against the supplier, not us.

Making your Booking
Bournemouth Beach Holidays will make every effect to find suitable accommodation for you. The suppliers that we work with display their accommodation on our website and you can make a booking request through us by filling out the enquiry form on the website for your chosen accommodation or by emailing us at info@bournemouthbeachholidays.co.uk or by calling us on 01202 387321 with your requirements.
Once you have contacted us by email or phone informing us of your accommodation and availability requirements, one of our reservations team will call the supplier on your behalf and will call or email you back to confirm (or not) the booking. All bookings are subject to a confirmation of availability from the supplier. We reserve the right to decline any booking at our discretion. We aim to call or email you back as soon as possible of your request to report back about the supplier which may have accommodation to suit your requirements.
You are not committed to any accommodation or secured your booking until the following process has been completed.
You are required to pay a non-refundable £35.00 deposit or 20% of the total cost (which ever is greater) to secure your booking.
Before you confirm your booking you should carefully read the terms and conditions of the accommodation provider which will be brought to your attention. If you proceed to confirm your booking it will be deemed that you have read the terms and conditions of Bournemouth Beach Holidays and that you accept them.
Following a successful booking Bournemouth Beach Holidays will as soon as it is practicable, send you written confirmation in the form of email (unless otherwise agreed). No contract shall come into being until Bournemouth Beach Holidays has sent you such written confirmation.
Please make sure that upon receipt of the written confirmation or other communication from us, you check them carefully to make sure they accord with our agreement. If they do not, please contact us immediately to highlight your concern. Please note that it is your obligation to assist us to mitigate the potential loss caused by any errors by giving us adequate notice of any problem. It is important that all the information you give us when you contact us or otherwise when you use the website, is correct. This includes, without limit, ensuring that we have your correct contact (including e-mail) details at all times. We cannot be held liable for sending you any relevant information where you have given us incorrect contact details.
Group Bookings with 10 or more people
An initial £50.00 non-refundable deposit is required to secure the accommodation at the time of booking. Group members are then required within 7 days to pay a £35.00 deposit to confirm their place on the booking. This deposit is non-refundable and non-transferable. Accommodation is held on the understanding that deposits are received within the 7 days.
The final balance for all group bookings is due 6 weeks prior to the arrival date. Bookings made within 6 weeks of arrival must be paid for in full. If full payment is not received by the balance due date, we will notify the accommodation provider who may cancel your booking and charge the cancellation fees set out in their Terms and Conditions.
Some hotels may require a bond on arrival at the hotel in the form of cash or credit card to cover any potential damages to the hotel.
Bournemouth Beach Holidays will only deal with the group leader. The group leader is the person who makes the booking on behalf of the other members of the group and who will be named on all correspondence. It is the responsibility of the group leader to ensure that all payments for the group are made by the date due which will be notified by us in writing. Before you confirm your booking it is important to carefully read the terms and conditions of the supplier which will be brought to your attention, either by reference to a link on our website or by asking you to go directly to the website of the supplier. These terms and conditions apply to all members of your group and apply weather you have read them or not. If you proceed to confirm your booking it will be deemed that you have read the terms and conditions of the supplier and that you accept them. You may change the name of the group leader at any time but must give us written notice.
Bournemouth is extremely busy during the summer months, therefore it is advisable to book group accommodation for the summer months as far in advance as possible to secure the best possible choice of accommodation.
If you change your booking
Should you wish to make any changes to your booking, you must notify us in writing (by post, fax or email) as soon as possible. An amendment fee of £15.00 per amendment will be charged (unless it is to increase the value of the booking). Cancellation charges may apply where changes are made after the date when the final payment is due. Please read the terms and conditions of the accommodation provider.
If you want to cancel your booking
Should you (or if a group booking then the group leader) need to cancel your booking once it has been confirmed, you must notify us in writing (by post, fax or email as soon as possible). Please note that once your booking has been confirmed to us, you can only cancel the booking in accordance with the relevant accommodation provider terms and conditions which may involve cancellation charges. Equally you may also be subject to our cancellation charges to cover our administration costs. Please be aware that single occupancy charges may apply if one person is occupying a double or twin room on their own.
Accommodation
Sometimes your accommodation provider may need to make a change. If you have already booked we will let you know as soon as we can, if there is time before your departure. The named accommodation will remain confidential to Bournemouth Beach Holidays and only be disclosed to you upon receipt of the individual deposits.
In the unlikely event that your accommodation provider has to make a major change or alteration to your booking, they will offer you the option of accepting the change or cancelling the booking and receiving a full refund of all monies paid to us in connection with the accommodation booking.
Children and Infants
Children sharing a room with their parents are normally charged at 50% of the adult rate or just pay for meals. Please ask when making your booking for special children's offers. Some accommodation providers sometimes place restrictions of the times children can use the leisure facilities, please ask at the time of booking.
Family Offer - Free Childrens' Tickets
Children can choose free tickets to a number of attractions listed on the Bournemouth Beach Holidays days out page. Tickets are only issued for children that are staying with their parents who have booked through Bournemouth Beach Holidays. Tickets are issued to the children relevant to their age. Minimum booking cost applies: Bookings over £200 = 1 free child ticket. Bookings over £300 = 2 free children's tickets.
Special Requests
This is an accommodation agency service and a request may be beyond the services listed on the website. Where possible we are happy to work with our suppliers to try to ensure that the special request is met. However, special requests cannot be guaranteed, and we cannot be liable if the special request is not met.
Behaviour
We reserve the right to terminate without notice the travel arrangement of any client whose behaviour is likely to cause upset, danger or damage to a property. The person(s) concerned will be required to leave the accommodation, service or activity immediately and no refunds will be made and we will not pay any expenses incurred.
Complaints Procedure
If you have any complaints regarding your bookings for services, please contact Bournemouth Beach Holidays Immediately and we shall do our best to resolve such issues.
Any dispute between us will be governed by the non-exclusive law and jurisdiction of the English or Scottish Courts.
Insurance
You are strongly advised to take out adequate travel insurance prior to arriving at your accommodation. It is your responsibility to check you have adequate insurance cover. The insurance should cover, amongst other things, cost of cancellation by you, personal losses and all medical costs.
Bournemouth Beach Holidays Package Holidays
When you book a 'package' with us, your contract will be with Bournemouth Beach Holidays
A “package holiday” is a combination of at least two out of (a) transport (b) accommodation © other tourist services (not ancillary to any transport or accommodation and forming a significant part of the arrangements) where booked through us at the same time, for which payment is made to us and which last at least 24 hours or include over night accommodation.
If you book a package through us, once your booking has been confirmed we accept responsibility for it in accordance with these booking conditions as an 'organiser' under the Package Travel, Package Holidays and Package Regulations 1992.
Your contract begins when you have paid a deposit and receive the booking confirmation.
Making a booking
You are not committed to any accommodation or secured your booking until the following process has been completed. You are required to pay a non-refundable £35.00 deposit to secure your booking.

Bournemouth Beach Holidays reserves the right to reject any bookings without giving any reasons.
It is important that all the information you give us when you contact us or otherwise when you use the website, is correct. This includes, without limit, ensuring that we have your correct contact (including e-mail) details at all times. We cannot be held liable for sending you any relevant information where you have given us incorrect contact details.
What's included in the package
Your full package details will be sent out when you pay your final balance. No transport is included in your package unless stated.
Group Bookings

Please note, in order for some activities to go ahead there may be a minimum number of people required.
If you want to change your booking
Should you wish to make any changes to your booking, you must notify us in writing (by post, fax or email) as soon as possible. An amendment fee fee of £15.00 per amendment will be charged (unless it is to increase the value of the booking). Cancellation charges may apply where changes are made after the date when the final payment is due.
Transfer of bookings
It may be possible if a group member cancels to transfer their booking to a person who satisfies all the conditions applicable to the package, provided that the group member gives reasonable notice to Bournemouth Beach Holidays of their intention to transfer before the start of the package date.
A £15.00 administrative charge would apply to all changes.
If YOU cancel your booking
Certain arrangements and activities may not be amended after they have been confirmed and any alteration could incur a cancellation charge of up to 100% of that part of the arrangements. In some cases, any changes made may mean you having to pay for the cancelled arrangements and purchasing new ones at full cost. For example music, theatre and sporting tickets are completely non-refundable and non- transferable.
Should you need to cancel your booking once it has been confirmed, you must notify us in writing (by post, fax or email) as soon as possible and the charges below will apply from the date we receive the notice in our offices.
Please note the following cancellation charges will apply.
• More than 42 days prior to arrival – deposit • 42 – 0 days prior to arrival – 100% cost of holiday
Cancellations made directly with the accommodation provider will not be effective.
If WE make a change or cancel your booking
Though it is very unlikely If a Significant Change to your holiday occurs and we are unable to provide the booked travel arrangements you will have the choice of:
• accepting the change of arrangements
• taking our offered substitute package of equivalent or superior quality if we are able to provide one.
• taking our offered substitute package of a lower quality if we are able to provide one and accept a refund from us of the difference in price between the price of the package purchased and the substitute one offered.
• cancelling your holiday with a full refund of all monies paid.
Force Majeure
Bournemouth Beach Holidays cannot accept responsibility or pay any compensation where the performance or prompt performance of the contract is prevented or affected by reason of circumstances which amount to "force majeure". Circumstances amounting to "force majeure" include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of your accommodation (which cannot reasonably be remedied to a satisfactory standard before the start of your stay) through fire, flood, explosion, storm or other weather damage, break-in, criminal damage, riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity, epidemic and all similar situations beyond our control.
Concert, Show and Event Tickets
Bournemouth Beach Holidays has no liability for the cancellation of a show or other event or the non-appearance of any particular cast member in a theatrical performance. In the unlikely event that a show or event is cancelled Bournemouth Beach Holidays will refund only the proportion of the holiday cost relating to the ticket charge. Bournemouth Beach Holidays will not be responsible for any delay in the delivery of tickets due to circumstances beyond its control. It is the responsibility of the ticket holder to contact Bournemouth Beach Holidays in the event of non-delivery. All theatre, show, sporting, music and event tickets are completely non-refundable and non-transferable.
Activities including Restaurant Bookings
Bournemouth Beach Holidays cannot be held liable if you are late or fail to turn up for any activities or arrangements made through us. It is your responsibility to turn up on time and have insurance in place if you are participating in any sports or activities. Any participation is at your own risk and Bournemouth Beach Holidays will not be held liable for any Injury.
Any additional food and/or beverage purchases over and above what is included in your restaurant and event package must be paid directly to the restaurant and/or event venue. You are advised to confirm your booking with the restaurant direct prior to your arrival.
Third Parties
Many of the services which make up your package are provided by independent suppliers. Those suppliers provide these services in accordance with their own terms and conditions. The contract between Bournemouth Beach Holidays and you is subject to any terms and conditions of contracts with the third party. Copies of these terms and conditions are available on request from the supplier concerned.
Financial Security
Except for monies that you pay to us for bookings made up of accommodation only, all monies that you pay to us in respect of your break will be held in a specifically designated bank account administered by independent trustees until your break is over or the monies are refunded to you. These arrangements mean that (unless you have made a booking for accommodation only) this money will be refunded in the unlikely event of our being unable to provide your break due to our insolvency.
General Terms
While all the information displayed on this website, including, without limit, descriptions of accommodation and attractions, and details of prices and availability, is believed to be accurate by Bournemouth Beach Holidays, the information has been provided to Bournemouth Beach Holidays by its suppliers. The information is therefore provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we and third parties connected to us hereby expressly exclude:
All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our website or in connection with the use, inability to use, or results of the use of our website, any websites linked to it and any materials posted on it, including, without limitation any liability for: loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
The English courts will have exclusive jurisdiction over any claim arising from, or related to, these terms or to a visit to our website although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms of use are governed by English law.
Commentary and other materials posted on our website are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our website, or by anyone who may be informed of any of its contents.
We aim to update our website regularly, and may change the content at any time. If the need arises, we may suspend access to our website, or close it indefinitely. Any of the material on our website may be out of date at any given time, and we are under no obligation to update such material.
We process information about you in accordance with our privacy policy. By using our website, you consent to such processing and you warrant that all data provided by you is accurate.

In order to confirm your booking, Bournemouth Beach Holidays needs to use information such as your name, address, credit card details and special dietary requests.
We take full responsibility for ensuring that proper security measures are in place to protect your information and share information in secure databases at secure addresses to prevent unauthorised access. In making this booking, you consent to this information being passed onto the suppliers.
